A major lawsuit against GitHub, Microsoft and OpenAI has hit a roadblock.
A California judge dismissed nearly all the claims from developers who accused these companies of copying their code.
Initially, the lawsuit had 22 claims, including copyright violations, due to GitHub Copilot, an AI coding assistant powered by OpenAI’s technology.
The judge dismissed most of these claims but left two standing: one for open-source license violation and another for breach of contract.
What you should know about the case:
The court dismissed most claims, including those under the Digital Millenium Copyright Act (DMCA).
The remaining claims involve open-source license violation and breach of contract.
The case isn’t over yet, as these two claims will still be litigated.
The judge’s ruling dealt a blow to the assertion that Copilot’s code suggestions infringe on copyrights by not attributing original developers.
Even though the complaint mentioned GitHub’s filter to detect and suppress such matches, the judge found the copied code not sufficiently similar.
The case will proceed on the remaining two claims.
Maybe they should have used ChatGPT to write them a more compelling case.

Microsoft is set to raise prices for its Xbox Game Pass Ultimate and PC Game Pass in September.
The Ultimate subscription will jump to $19.99 per month, up from $16.99, while PC Game Pass will increase to $11.99 per month, from $9.99.
Here are the numbers:
Ultimate Subscription: Increasing to $19.99/month.
PC Game Pass: Rising to $11.99/month.
New Standard Option: $14.99/month, includes online multiplayer but no day-one titles.
Alongside these hikes, a new Xbox Game Pass standard subscription will launch soon, costing $14.99 per month.
Unlike Ultimate, it won’t offer day-one first-party Xbox games but will include online console multiplayer.
This move comes as Microsoft plans to add major titles like CoD: Black Ops 6 to its Game Pass service later this year.
These changes primarily affect Ultimate subscribers, who are the majority of Game Pass users.
Existing Xbox Game Pass for Console subscribers will continue with their current plan, but new users will have to opt for the new Standard subscription from July 10th until the new option becomes available.
Current subscribers can stack their plans for up to 13 months from September 18th.
The price increase has already seen backlash online, though Microsoft shows no signs of back peddling.
